Terms & Conditions
1. About these terms
LoansFinder.co.nz (the "Website") is operated by Profitech Credit Solutions (the "Operator", "we", "us" or "our"). Alexander Balanoff is the founder of LoansFinder NZ. References to LoansFinder mean the Website and the services provided by the Operator.
These terms govern use of the Website and our information, comparison and referral services. Where you expressly accept these terms, or otherwise enter into a binding agreement incorporating them, that agreement is with the Operator. A business does not become a party to these terms merely because we publish information about it.
Our Privacy Policy explains how we handle personal information. Any separately agreed written advertising or referral contract takes precedence over these terms for the services it specifically covers, subject to applicable law.
2. Your statutory rights
Nothing in these terms excludes, restricts or modifies any right, remedy or obligation that cannot lawfully be excluded, restricted or modified. This includes applicable protections under the Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020.
This section takes precedence over every disclaimer, limitation of liability, indemnity and other provision below. These terms do not authorise misleading statements, unlawful publication or infringement of another person's rights.
3. Our services and their limits
LoansFinder is an information, comparison and referral platform. We do not lend money, approve credit applications, set loan terms or enter into credit agreements on a lender's behalf. Our content is general information, not personalised financial advice or an assessment of a product's suitability for you.
A listing, comparison, article or referral is not an offer of credit or an assurance of approval, savings or a particular outcome. The lender is responsible for its lending decisions, checks, disclosures and credit agreement. You must be at least 18 to submit a loan enquiry through the Website and satisfy the relevant provider's eligibility requirements.
We do not represent that our listings cover every provider or product available in New Zealand. Inclusion does not, by itself, establish a provider's regulatory status, financial standing or suitability.
4. Information, rates and calculators
We take reasonable care when preparing information, but provider details and product terms may change between updates. Rates, amounts, fees, eligibility criteria and funding times are indicative unless expressly stated otherwise. An advertised starting rate may not be available to every applicant.
Check current information directly with the provider and read its disclosure statement and credit agreement before accepting an offer. Calculator results are estimates based on the inputs and assumptions shown; they may not include every fee or reflect the lender's calculation method. They are not quotations or credit decisions.
Please report material inaccuracies to info@loansfinder.co.nz. We will review credible reports and correct material errors we identify.
5. Business listings and editorial control
We may publish original descriptions, comparisons and factual information about providers using public sources, information supplied to us and other material we are lawfully entitled to use. A listing may be created without a commercial relationship with the business concerned, where publication is lawful.
Subject to applicable law and any binding agreement, we retain editorial control over the selection, wording, organisation, updating and retention of listings. A listed business does not acquire ownership of our original content or a right to approve it merely because the content refers to that business.
Our approach is to retain accurate, relevant and lawfully published factual listings. A preference not to be listed, disagreement with a substantiated comparison, withdrawal from an affiliate programme or the end of an advertising relationship does not, by itself, require deletion of an otherwise lawful listing.
Where appropriate, we may update a listing to reflect a closure, rebrand or discontinued product rather than delete it. Historical information will be identified as such and must not imply that an unavailable service remains available. Retention remains subject to privacy, accuracy and other legal requirements.
6. Corrections, objections and removal requests
Send listing concerns to removals@loansfinder.co.nz or info@loansfinder.co.nz. Please identify the page URL, the specific material concerned, your relationship to it, the reason for your request and any supporting evidence. We may request proportionate verification of identity or authority where necessary.
We assess requests on their merits, including concerns about accuracy, defamation, copyright, trade marks, confidentiality and personal information. Where a correction, clarification, removal of a particular image or deletion of specific personal information adequately resolves the concern, we may retain the remaining lawful listing.
We will review requests within a reasonable time, prioritise credible reports of serious harm or unlawful content and meet applicable statutory deadlines. We may restrict disputed material while reviewing it and will explain our decision where reasonably practicable. A request does not automatically require removal, but neither publication nor these terms overrides a valid legal right or binding order.
Personal information about sole traders, staff or other identifiable individuals is subject to applicable privacy requirements even when it appears in a business listing or public source. Access, correction and retention requests will be assessed accordingly. We do not charge for considering a listing correction or removal request.
7. Intellectual property and business identification
Copyright in our original text, design and other protected Website material belongs to the Operator or its licensors. Business names, product names, trade marks and third-party materials remain subject to their owners' rights. Public availability does not, by itself, make protected material free to reproduce.
References to businesses and products are used for identification, information and comparison where lawful. Logos, images and substantial extracts require permission or another applicable lawful basis. A reference or link does not itself imply endorsement, sponsorship or affiliation.
You may read, link to and make reasonable personal copies of our content. Substantial republication or commercial reuse of protected material requires permission unless permitted by law. Nothing here restricts lawful quotation, criticism, review or other statutory exceptions.
8. Material supplied for publication
If you submit descriptions, images, logos or other material specifically for publication, you confirm that you have authority to supply it and that, to your knowledge, it is accurate and lawful. You retain ownership and grant us a non-exclusive, royalty-free licence to reproduce, format, reasonably edit and display it for the submitted listing or publication. Editing must not materially misrepresent its meaning.
Unless separately agreed, you may withdraw this permission by written notice. We will stop using material that depends on that permission within a reasonable period, sooner where legally required. Withdrawal does not require deletion of independently sourced facts or our original content that we can otherwise lawfully retain. Copies needed for legal records remain subject to applicable retention requirements.
This publication licence does not apply to loan applications, identity documents, financial information or private correspondence submitted for another purpose.
9. Advertising, referrals and paid placements
We may receive advertising payments, referral fees or affiliate commissions from providers or commercial partners. These arrangements may affect which providers are featured and where content appears. Advertising and paid placements will be identified so their commercial nature is clear.
Payment does not entitle a business to misleading claims or the suppression of material corrections. Ending a paid arrangement ends the relevant paid services in accordance with its contract; it does not automatically remove a separate factual listing. We do not promise traffic, search rankings, enquiries or sales unless expressly agreed in writing.
10. Enquiries, privacy and third-party services
Information submitted through an enquiry form must be accurate to the best of your knowledge and supplied with authority. How it is collected, used and shared is explained in the relevant form notices and Privacy Policy. These terms do not provide blanket consent to unrelated marketing or unrestricted disclosure.
An enquiry may be passed to participating lenders or referral partners as disclosed at the point of submission. Those organisations may apply their own terms and privacy notices. We remain responsible for our own conduct and legal obligations when handling or sharing information.
External websites and providers operate separately from LoansFinder. Their products, decisions and performance are their responsibility; linking or referring to them does not make the Operator a party to your agreement with them.
11. Acceptable use
You must not use the Website to submit fraudulent enquiries, impersonate another person, publish unlawful material, distribute malicious software, access restricted systems without authority or materially disrupt the service. Automated access must not bypass access controls, infringe rights or impose an unreasonable load.
We may proportionately restrict access where reasonably necessary to address misuse, security threats or legal obligations. Where practicable, we will give notice and an opportunity to resolve the issue. Making a genuine complaint or exercising a legal right is not misuse.
12. Website availability
We may maintain, update or discontinue Website features for operational, security, editorial or legal reasons. Continuous availability and error-free operation are not promised. Any change to a separately contracted paid service remains subject to that agreement and applicable rights to notice, cancellation or a refund.
13. Responsibility and limitations of liability
Subject to section 2, we are not responsible for losses to the extent they are caused by a provider's independent conduct, information you supply incorrectly, your unlawful use of the Website or events outside our reasonable control. These provisions do not excuse loss caused or contributed to by our own breach of duty.
To the extent permitted by law, we exclude liability for losses that were not reasonably foreseeable when the relevant agreement was made. For business users bound by these terms, we also exclude indirect or consequential business losses, subject to applicable unfair contract terms protections. We do not exclude direct losses merely by describing them as consequential.
No exclusion or limitation applies to fraud, wilful misconduct or liability that cannot lawfully be limited. Nothing removes responsibility imposed by applicable consumer, privacy, intellectual property or defamation law.
14. Founder and other representatives
Alexander Balanoff and other authorised representatives act for the Operator when carrying out Website activities. Their identification as founder, author, editor or contact person does not, by itself, make them a party to an agreement with you, a lender or a personal guarantor of the Operator's obligations.
Unless expressly agreed in a separate personal undertaking, contractual obligations under these terms are those of the Operator. Any lawful exclusions and limitations in these terms are also intended to benefit Alexander Balanoff and the Operator's personnel acting within their authorised roles. They may enforce those benefits under Part 2, Subpart 1 of the Contract and Commercial Law Act 2017, where applicable.
This section does not exclude personal liability that the law imposes independently, or liability for a person's own fraud, wilful misconduct or other conduct for which liability cannot lawfully be excluded.
15. Responsibility for business submissions
If you act in trade and expressly accept these terms when supplying material for publication, you agree to reimburse the Operator for reasonable, evidenced losses and legal costs arising from third-party claims directly caused by your knowingly false statements, deliberate infringement of another person's rights or material breach of your authority to supply that material.
This obligation does not apply to ordinary consumers, losses attributable to our own fault or unauthorised alterations, or amounts recoverable elsewhere. We will notify you promptly, take reasonable steps to reduce loss and allow you to participate in the defence. We will not agree a settlement payable by you without your consent, not to be unreasonably withheld. Section 2 and applicable unfair contract terms rules apply.
16. Changes to these terms
We may update these terms to reflect changes in the Website, our services or the law. We will publish the revised version and its effective date. For material changes affecting an ongoing agreement, we will provide reasonable advance notice and seek further agreement where required.
Changes operate prospectively and do not remove accrued rights or retrospectively change how an existing dispute is handled. Changes urgently required for legal or security reasons may take effect sooner, with notice as reasonably practicable.
17. Complaints, governing law and general provisions
New Zealand law governs these terms. New Zealand courts and tribunals with jurisdiction may hear disputes. This does not restrict mandatory rights to use another competent forum, contact a regulator or seek urgent relief.
Please direct Website complaints to info@loansfinder.co.nz, identifying the issue and the outcome sought. Complaints about a lender's credit decision or agreement should also be directed to that lender and, where applicable, its dispute resolution scheme. Our complaints process does not suspend statutory deadlines or limit access to legal remedies.
If a provision is unenforceable, it is severed to the extent necessary and the remaining provisions continue where they can operate lawfully. A delay in exercising a right does not, by itself, waive that right. Provisions intended to continue after use of the Website ends remain subject to their stated limits and applicable law.
